About this Seminar:

David Bateson and Marion Smith QC take an apocalyptic view of international arbitration.

  • Does the increasing use of ADR, particularly statutory adjudication, signal the end for construction arbitration?
    David will look at the recent use of ADR, and particularly statutory adjudication in England, Singapore and Malaysia, and Dispute Boards.
  • Is international arbitration simply too expensive for end-users?
    Marion will look at recent decisions on costs, the Tribunal’s power to award security for costs, recent case management initiatives and the impact of third party funding.

About the Speakers:

David Bateson is a leading international arbitrator who has been involved in over 90 arbitrations in Asia, the Middle East, Africa, Europe and South America. He has acted as Chairman, party-appointed arbitrator, or sole arbitrator under the auspices of the AAA, CIETAC, HKIAC, ICC, KLRCA, LCIA, PCA, SIAC and VIAC, or in ad hoc arbitrations. He has extensive experience in disputes in a variety of industry sectors including, construction, resources, commodities, insurance, joint ventures, shareholder agreements, shipping and telecommunications.Chambers Asia 2016 described him as “pre-eminent and widely experienced”, “one of the top arbitrators in the region” who is “excellent at pretty much everything he is doing” and “an accomplished arbitrator, who is getting more and more cases in Asia, and worldwide”. Marion Smith QC specialises in complex, high value commercial and construction disputes for UK and international clients. She has practised across a broad range of sector areas including building, energy, engineering, financial services, insurance, power and telecommunications. Her Asia practice has expanded over recent years and she spends a significant amount of time in the region. Marion has extensive experience in international arbitrations and is a Fellow of the Chartered Institute of Arbitrators. She is a persuasive advocate and has appeared before a range of Tribunals, including under the rules of the ICC, KLRCA, LCIA, LMAA and the UNCITRAL Arbitration Rules in a range of jurisdictions.

For many years, Marion has been recognised by the legal directories. About the Chairperson:

francisgoh 

Francis Goh is an equity partner of Harry Elias Partnership LLP. He is the head of the firm’s arbitration practice and he also leads the firm’s Private Client practice. He graduated from the National University of Singapore in 1990 and has since been in active legal practice for 25 years. Francis is a fellow of the SIArb and currently serves on the SIArb Council. Francis is also a Principal Mediator with the Singapore Mediation Centre. His background in litigation and commercial disputes resolution gives Francis a distinct advantage in negotiations, advising on commercial contracts and corporate governance. Francis is well placed to guide companies and business owners to manage their risk, processes as well as business succession issues.
