The SCMA-SIArb Maritime Arbitrator’s Fellowship Course (“Cour
se”) will be offered by the Singapore Institute of Arbitrators (&ldqu
o;SIArb”) in conjunction with Singapore Chamber of Maritime Arbitration (“SCMA&rdq
uo;).
The Course will comprise SC
MA’s Maritime Arbitrator Accreditation Programme (“MAAP”)
held in conjunction with SIArb’s Fellowship Assessment Course (&ldqu
o;FAC”) and is suitable for aspiring maritime
arbitrators who meet the criteria for admission to the FAC.

COURSE SYNOPSIS
Fellowship Assessment Course (FAC)
SIArb’s FAC 2021 will be held online from
1 October - 8 November 2021 and consists of 6 modules with a total of 9 le
ctures, 6 practical workshops and an Award Writing Examination:
- Module 1 will cover the basic
concepts and principles on the sources of law, the law of contract, the la
w of tort, and the treatment of evidence. Candidates who have obtained a de
gree in law from a university or other tertiary institution recognised by t
he SIArb (or such other legal qualifications as the SIArb may in its absolu
te discretion accept) are exempted from Module 1. All other candidates are
required to attend Module 1 and attend Practical Workshop 1.
- Module 2 relates to (i) the a
cceptance of an arbitral appointment, covering topics such as conducting co
nflict checks and making disclosures before or when accepting an appointmen
t; (ii) dealing with jurisdictional challenges; and (iii) emergency arbitra
tions.
- Module 3 cover
s (i) case management in conducting an arbitration; (ii) techniques for con
trolling time and costs in an arbitration; and (iii) drafting procedural or
ders.
- Module 4
covers (i) dealing with interlocutory applications; (ii) drafting discovery
orders; (iii) dealing with costs of interlocutory applications; (iv) deali
ng with extension of time applications and guerilla tactics; and (v) dealin
g with preliminary issues.
- Mod
ule 5 covers the conduct of the evidentiary hearing.
- Module 6 covers the practical aspe
cts of actually writing the Final Award.
- In the Practical Workshops, lecturers and tutors will a
ddress questions from candidates and show practical examples of an arbitrat
or’s work product such as procedural orders, Redfern Schedules, disco
very orders and interim awards. In Practical Workshop 6, t
he workshop leader for Module 6 will dissect a sample award to see how it s
hould, or should not, be written.

he Award Writing Examination, candidates will write an enf
orceable final award.

Format an
d Delivery Method
- Each lec
ture will be delivered online by way of a Zoom webinar recording which can
be accessed remotely and on demand for self-study from 1 October – 8
November 2021. Each candidate is required to view each lecture in sequence
and in its entirety. The total scheduled duration of all lectures is about
13.5 hours.
- Practical Workshops will b
e on 5 and 6 November 2021 and will be led by one or more Workshop leaders
in a live interactive class conducted virtually on the Zoom meeting platfor
m. Each candidate is required to attend the full duration of each Practical
Workshop. The total scheduled duration of all 6 Practical Workshops is 10
hours.
- Each candidate who has been suc
cessfully registered for FAC will receive personalised login details to SIA
rb’s online course portal to access all reading materials, lectures,
presentations slides and the online award writing examination.
Criteria for Admission to FAC
The FAC will focus on teaching candidates the practical aspects of a
cting as an arbitrator. To benefit from FAC, candidates should already have
a sound grasp of the law of arbitration.
Accordingly, admission to the FAC is open to:
- Lawyers with at least 10 years involvement in lit
igation/dispute resolution; or who have been active arbitrators, and can pr
ovide documentary evidence of such experience; OR
- Non-lawyers who have at least 10 years of involvement in
dispute resolution or who have been active arbitrators, and who can pr
ovide documentary evidence of such experience; OR
- Those who have successfully completed the International E
ntry Course conducted by SIArb or such other equivalent course as may be re
cognised by SIArb.
Completion of FAC
To
complete the FAC successfully, a candidate must:
(a) Achieve 100% attendance at all the Practical Workshops; and

(b) Pass the open-book Award Writing Exa
mination.

Maritime Arbitrator Accre
ditation Program (MAAP)
SCMA’s MAAP will be held online on 29 October 2021 and consists of 2
workshops and a Written Assessment:
Module 1: The Legal Framework: Litigation & Maritime Arbit
ration – 2.5 hours
This module will cover an overview o
f maritime arbitration and issues specific to maritime arbitration, in part
icular, a discussion on various ADR solutions (costs and time frames), liti
gation (why it is less suited to commercial parties), and arbitration (adva
ntages and disadvantages of arbitration in a maritime context, fundamental
features of maritime arbitration and others).
Module
2: The SCMA Framework – 2.5 hours
This module will cov
er the SCMA framework for maritime arbitration and will include the SCMA Mo
del Arbitration Clauses, the Expedited Claims Procedure, the Expedited Arbi
tral Determination of Collision Claims (SEADOCC), managing arbitration and
legal costs, and managing the arbitration procedure.

ASSESSMENTS
- The FAC Award Writing Examination is an open-book
examination which will be conducted virtually on SIArb’s online cour
se portal and/or on the Zoom meeting platform over a period of 3.0 hours on
8 November 2021. Each candidate is required to sit for and pass this writt
en examination by writing an enforceable final award within the time and ba
sed on the facts given.
- The MA
AP Written Assessment is also an open-book examination which will be conduc
ted virtually on SIArb’s online course portal and/or on the Zoom meet
ing platform on 3 November 2021. Each candidate is required to sit for and
pass this Written Assessment.
CERTIFICATE(S) GRANTED UPON SUCCESSFUL COMPLETION
- A candidate who successfully
completes FAC and MAAP will be awarded a “Certificate of Fellowship
in Maritime Arbitration” jointly issued by SIArb and SCMA. A ca
ndidate who has successfully completed the Course may, subject to satisfyin
g other relevant criteria, apply for admission as a Fellow of the Singapore
Institute of Arbitrators.
- A candidate
who only successfully completes FAC will be awarded SIArb’s “F
ellowship Assessment Course Certificate”. A candidate who has s
uccessfully completed FAC may, subject to satisfying other relevant criteri
a, apply for admission as a Fellow of the Singapore Institute of Arbitrator

- A candidate who only successfully c
