About the Seminar:

In this seminar, Mr. Gary Born will discuss ethical issues for Arbitrators, such as the legal and practical aspects of arbitrator impartiality. After his presentation on ethical issues for Arbitrators, he will be joined by the SIArb Working Group which is releasing its draft Guidelines on Party-Representative Ethics for consultation. The SIArb Working Group will discuss the draft Guidelines with Mr Gary Born and the audience as part of its consultation process on this important but problematic area of what is expected of party representatives in international arbitration.

About the Speaker:

Mr. Gary Born is the President of the Singapore International Arbitration Centre (SIAC) Court of Arbitration and Chair of the International Arbitration Practice Group at Wilmer Cutler Pickering Hale and Dorr LLP. He is widely recognised as the world's leading authority on international arbitration and litigation. He has served as counsel in over 650 arbitrations, including several of the largest arbitrations in ICC and ad hoc history, and has sat as arbitrator in more than 200 institutional and ad hoc arbitrations. Mr Born is the author of International Commercial Arbitration (2nd ed. 2014), International Arbitration: Law and Practice (2nd ed. 2015) and numerous other works on international dispute resolution. He is an Honorary Professor of Law at the University of St. Gallen in Switzerland and Tsinghua University, Beijing, and teaches regularly at law schools in Europe, Asia, and North and South America. He is ranked by peers and clients as one of the leading international arbitration practitioners in the world. Among many accolades, he received the GAR inaugural "Advocate of the Year" award and is one of only two practitioners globally to achieve "starred" status for international arbitration in Chambers and Partners guides.

About the Chairperson:

Mr. Johnny Tan Cheng Hye, BBM is the founding partner of LT&T Architects where he practised for almost 30 years. Johnny practises now as an independent arbitrator. He is a Past President of the Singapore Institute of Arbitrators (SIArb), having served two terms as President from 2007 to 2011. Johnny is a member of the panel of arbitrators of several international arbitration centres including SIAC, SIArb, KLRCA, HKIAC, DIAC, SCIA, LCIA, IIAM, PIAC and SIA. He is also a member of the Advisory Council to the National Commercial Arbitration Centre, Cambodia. He is a Principal Mediator with the SMC, MHJMC and CCPIT/CCOIC Mediation Centre. An accredited adjudicator with the SMC, Johnny also sits on the Construction Adjudicator Accreditation Committee. Johnny has held various positions in the SIA and served as its Vice-President from 1998 to 2000. Johnny has been appointed as arbitrator in both institutional and ad hoc arbitration cases in Singapore, Brunei and Dubai. In addition to an active practice in architecture and ADR, Johnny also sits as Deputy Chairman of the Board of Governors of Singapore Polytechnic and chairs the School of Architecture and the Built Environment Advisory Committee and the Admin and Development Committee. He was also Chairman of the SP International Board.

About the Working Group:

Mr. Chan Leng Sun SC is Baker & McKenzie’s Global Head of International Arbitration. He is qualified in Malaysia, Singapore and England. Leng Sun was appointed Senior Counsel in January 2011. Apart from being counsel, Leng Sun is a Chartered Arbitrator and is also on the panel of leading arbitral institutions.

Leng Sun is President of the Singapore Institute of Arbitrators (SIArb). He is a member of the Committee on the Singapore International Commercial Court. Leng Sun was a legal officer of the United Nations Compensation Commission in Geneva and a SIAC-CIAC Observer to the UNCITRAL Working Group on Arbitration. He is the author of the book Singapore Law on Arbitral Awards and Co-Editor of Conflict of Laws in Arbitration.

Mr. Mohan Pillay is the Joint Head of the Singapore Joint Law Venture, Pinsent Masons MPillay LLP, and Managing Partner of the Singapore constituent practice of MPillay. He is a Singapore and UK qualified dispute resolution lawyer with nearly 30 years’ experience in advisory, commercial litigation and regional arbitration work. Mohan is a Chartered Arbitrator and appears regularly as Lead Counsel before the Singapore High Court and Court of Appeal. He is Co-Chair of the Dispute Resolution & Arbitration Committee, Inter-Pacific Bar Association (IPBA). His past appointments include President, Singapore Institute of Arbitrators, and Past Chairman, Society of Construction Law (Singapore), as well as teaching appointments as Adj. Assoc. Professor, Faculty of Law, National University of Singapore (2003 - 2011) and Visiting Professor, Centre of Construction Law & Dispute Resolution, King’s College London (2005 – 2011). He is one of the General Editors of Singapore Construction Adjudication Review, as well as a General Editor of the Singapore Journal of Construction Law.

Mr. Rian Matthews is a Local Principal in the Dispute Resolution practice at Baker McKenzie.Wong & Leow. Rian represents clients in a range dispute resolution mechanisms, such as mediation, early neutral evaluation / adjudication, international arbitration, commercial litigation and other forms of Alternative Dispute Resolution.

Rian has extensive experience with both international arbitration and commercial litigation, and in particular with disputes involving cross-border and multi-jurisdictional issues. Rian regularly works with clients across a range of sectors, including banking / finance, energy, mining and construction.

Ms. Adriana Uson Ong is a Counsel at the Singapore International Arbitration Centre (SIAC). She has administered over 200 cases under various versions of the SIAC Rules and UNCITRAL Arbitration Rules, including cases conducted under the Expedited Procedure, Emergency Arbitration, SIAC-SIMC Arbitration-Mediation-Arbitration Protocol, and cases involving investor-state disputes.

Adriana was also a member of the drafting/rules revision committees for SIAC Rules 2016, SIAC Investment Arbitration Rules 2017 and SIAC Practice Note on Arbitrator Conduct in Cases Involving External Funding.
