The lecture will confront the erosion of international law and rising protectionism, arguing that despite serious setbacks to the global rule of law, international arbitration remains a genuine success story and a viable path to restoring trust in international norms. It intends to draw parallels between inter-State, investment, and commercial arbitration, framing all as consent-based mechanisms that could gradually build a harmonized body of jurisprudence bridging legal cultures worldwide.
The heart of the speech is eight concrete proposals for the arbitration community:
(1) upholding the highest ethical standards in proceedings;
(2) fostering greater collaboration between arbitral institutions;
(3) rethinking arbitrator selection and appointment methods;
(4) improving counsel conduct by discouraging aggressive, inefficient advocacy;
(5) addressing arbitrator liability and immunity amid rising legal attacks on awards;
(6) harnessing AI’s benefits for efficiency and accountability while guarding against privacy and confidentiality risks;
(7) containing costs and introducing duration control mechanisms; and
(8) strengthening the relationship between arbitral tribunals and national courts through pro-enforcement culture and judicial training.

Distinguished Speaker:
Loretta specializes in international commercial arbitration, investment arbitration and public international law. She sits as arbitrator in proceedings under a variety of arbitration rules, including ICSID, ICC, UNCITRAL, SCC, SIAC, LCIA and DIAC. Loretta also has extensive experience as counsel and advocate in State-to-State disputes before the International Court of Justice and in ad hoc arbitrations. She is a past member and Vice-President of the ICC International Court of Arbitration. She currently sits on the Governing Board of ICCA and was a vice-President of ICCA until April 2024. Loretta was appointed to the ICSID Panel of Arbitrators by the Chairman of the World Bank. She is a member of Governing Board of the Centre for International Law of the National University of Singapore, is a Vice Chair of the International Arbitration Court of the Korean Commercial Arbitration Board (“KCAB International”) and she is a member of the Council of the ICC Institute of World Business Law, of the Arbitration Committee of the British Virgin Islands International Arbitration Center (“BVI IAC”). Loretta is one of the co-authors of the second edition of The ICSID Convention – A Commentary published by Cambridge University Press in 2009 and one of the editors/authors of the 3d edition published in 2022. She is also a member of the Editorial Board of The Law and Practice of International Courts and Tribunals, and an editor of the International Litigation in Practice Series, both published by Brill. Apart from her native Italian, Loretta is fluent in English, French and Spanish.

Ms Tan Weiyi is a partner at Clyde & Co Singapore. She represents and advises clients in a range of cross-border commercial disputes, including transactional, licensing, intellectual property, employment and tenancy disputes. Weiyi also represents clients in investigations and enforcement actions, focused on corruption, financial fraud and other white-collar criminal offences.
Weiyi is an accredited arbitrator and mediator, and has been appointed as sole arbitrator in SIAC proceedings and co-mediator in mediation proceedings administered by the SMC. She serves as the Vice-President of the Singapore Institute of Arbitrators and chairs the Institute’s Communications Committee. She is also appointed to the GST Board of Review by the Ministry of Finance and to the Board of Regents of the Association of Certified Fraud Examiners. Weiyi has published in various arbitration journals, including the Asian International Arbitration Journal and Contemporary Asia Arbitration Journal. She is recognised as “Next Generation Partner” for White Collar Crime by The Legal 500 and named “Litigation Star”, White Collar Crime by Benchmark Litigation.
