Judges and arbitrators both resolve disputes, but how different are they really?

The discussion will span two broad themes. The first looks at case management: how proceedings are run differently in court versus arbitration, how practitioners from diverse legal and cultural backgrounds are navigated, and whether the spectre of due process paranoia in arbitration is something judges find themselves freed from when on the bench. The second turns to decision-making: how the role of judge versus arbitrator shapes the way decisions are reached and written, whether courts are more willing to deploy preliminary issues as a tool, and whether the pace of justice differs meaningfully between the two forums.

Whether you are a litigator, an arbitration practitioner, or someone who moves between both worlds, this session promises a candid and thought-provoking exchange on the topic of dispute resolution.
