CASE LAW DEVELOPMENTS: Rakna Arakshaka Lanka Ltd v Avant Garde Maritime Services (Pte) Ltd [2019] SGCA 33

The Singapore Court of Appeal in this case allowed an appeal against the High Court’s decision which refused to set aside an award (the “Award“) issued in an arbitration administered under the auspices of the Singapore International Arbitration Centre (“SIAC“).
In coming to its decision, the Court of Appeal discussed and set out important principles governing, amongst others:-

CASE LAW DEVELOPMENTS: BWF v BWG [2019] SGHC 81

This High Court decision concerns an application by the plaintiff for an injunction to restrain the defendant from bringing winding up proceedings against the plaintiff on the ground that the contract between the parties obliged them to proceed to arbitration to resolve their disputes. The Court granted the injunction. An appeal by the defendant against the High Court’s decision on this application is currently outstanding.

SIArb-JAA Programme on International Commercial Arbitration (21, 22 May 2019)

International Entry Course 2019 (26, 27 & 29 April 2019)

The Singapore Institute of Arbitrators’ annual and signature International Entry Course (IEC) is a comprehensive and substantial programme which consists of 4 modules and a Written Examination. These 4 modules cover the key aspects and fundamental concepts of arbitration; the differences between arbitration and other forms of dispute resolution; the differences between institutional and ad hoc arbitrations; the laws and rules applicable to an arbitration; the arbitration agreement; appointment of the arbitral tribunal; the jurisdiction, powers, rights and duties of the tribunal; challenges to the tribunal; the arbitration process and procedure; the award and its recognition and enforcement. Arbitral Decision-making: Art, Science or Sport? (11 April 2019)

SIArb is privileged to welcome back Professor Lucy Reed, who was on an esteemed panel of speakers at the Institute’s “Party-Representative Ethics: Time to move the Needle?” session in January, where she had shared some thought provoking views on what arbitral tribunals could do to set the tone of the proceedings and deal with complaints on counsel misconduct and disruptive or inappropriate behaviour.
Prof Reed, as Director of the NUS Centre for International Law and Professor at the NUS Law Faculty, and a former Vice President of SIAC and ICCA, brings with her decades of both practical and academic experience. At this latest seminar, she gave a light-hearted lecture of the differences one would find with the “Art” versus the “Science” in the decision making process, and finding the balance between them.

The SIArb Newsletter is a publication of the Singapore Institute of Arbitrators aimed to be an educational resource for members and associated organisations and institutions of higher learning. Readers of the newsletter are welcome to submit to the Secretariat at secretariat@siarb.org.sg well-researched manuscripts of merit relating to the subject matter of arbitration and dispute resolution. Submissions should be unpublished works between 1,500 to 2,500 words and are subject to the review of the editorial team
