Getting the Architecture of the Arbitration Right – Model Procedural Order No 1

About the Seminar:

Neither the Model Law nor most institutional rules set out what procedural orders need to be made by a Tribunal nor in what sequence the procedural steps need be taken. This is presumably due to the belief that each arbitration should have a tailor-made procedure designed for it rather than taking a ready-made procedural order which can be applied for every arbitration regardless of its special needs.

This talk seeks to identify what are the common procedural orders that are made in most cases, and when they might be modified, omitted or added to. A Model Procedural Order No 1 typically used by the speaker will be circulated and discussed, which will anticipate and provide possible solutions to the common problems encountered in every arbitration, including directions on evidential matters in the actual hearing. There will also be incorporated in this Model Procedural Order the speaker’s model orders to protect confidentiality in arbitration, which have now been internationally recognized and named as “the Hwang Model Procedural Order on Confidentiality’.

Two experienced arbitration counsels will comment on the proposed Model Procedural Order No 1 and lead a discussion and Question & Answer session on the subject. Delegates will be provided with an advance copy of the Model Procedural Order No 1 and encouraged to participate in the open discussion.

About the Speaker:

Mr. Michael Hwang, SC was educated at undergraduate and postgraduate levels at Oxford University where he was a college scholar and prize winner. He began his legal career teaching law at the University of Sydney. He then joined Allen & Gledhill in Singapore, where he remained for over 30 years. He now practises as an independent Barrister and Arbitrator. In 1991-1992, he served as a Judicial Commissioner of the Supreme Court of Singapore. From 2001-2003, he was a UN Compensation Commissioner in Geneva. He is on the panels of the ICSID and 14 national arbitration centres. He is also a member of the ICC Court, and has recently been appointed the Chief Justice of the Dubai International Financial Centre. 

About the Commenters: 

Steven is the Managing Director of Clasis LLC, a Singapore law firm; working in association with Clyde & Co. Steven has more than 18 years' experience in disputes, particularly in arbitration, construction, shipbuilding, energy and oil and gas cases. Steven has represented clients in large and complex international arbitrations before several arbitral institutions, including the ICC, LCIA and SIAC and under the UNCITRAL rules. Steven also sits as an arbitrator. He is a member of the ICDR's International Panel of Arbitrators, the SIAC Panel of Arbitrators and the KLRCA Panel of International Arbitrators and sits as an arbitrator for ICC cases. Steven has been appointed an emergency arbitrator by the SIAC. Steven is a Fellow of the Singapore Institute of Arbitrators.

Steven has received recognition as a leading individual in international arbitration and in international dispute resolution in Singapore, Hong Kong and Asia-wide in the Chambers Global and Chambers Asia directories where he has been described as "a prominent counsel in arbitration", "a pragmatic international arbitration professional who turns out quality work every time", "an excellent communicator - he identifies the salient issues to pursue and lets you know what the game plan is. Ben Giaretta is the Head of International Arbitration in Asia for Ashurst LLP. A specialist in international commercial arbitration, Ben is a Fellow of the Singapore Institute of Arbitrators and a Fellow of the Chartered Institute of Arbitrators, and is also on the panel of arbitrators of the SIArb, the SIAC and the KLRCA. He has worked on a wide variety of disputes, mainly in the energy, transport, construction, engineering and infrastructure sectors. Ben appears as Counsel in international arbitration, and has also been appointed as sole arbitrator, party-appointed arbitrator, Emergency Arbitrator and Chair of Tribunal, under various arbitration rules.
