About this Seminar:-

The vibrancy of the Singapore arbitration scene cannot escape notice of international users. An increasing number of foreign lawyers have set up presence in Singapore in their quest to be part of the action. SIAC’s case numbers too have continued to rise steadily in 2013. Against this backdrop, Singapore courts, which have hitherto been slow to set aside or refuse enforcement of international arbitration awards, had in 2013 done so in at least 3 international cases.

The speaker will share his observations and insights on some of the judicial decisions rendered, and consider the approach that the Singapore courts have taken in recent cases that have involved recourse against international arbitration awards. Notable decisions deserving comment will include the Court of Appeal’s decision in PT First media TBK v Astro Nusantara International BV and others [2013] SGCA 57; International Research Corp PLC v Lufthansa Systems Asia Pacific Pte Ltd [2013] SHCA 55 and the High Court decision in BLB and Anor v BLC and Ors [2013] SGHC 196. He will examine and consider if there is indeed any new trend being set and if so, whether the same accords with the judicial approaches adopted in other Model Law jurisdictions.

About the Speaker: 

Prof Lawrence Boo is the author of “Halsbury’s Laws of Singapore Volume 1(2) - Arbitration” (Lexis-Nexis 2011 Re-issue), the chapter on Singapore in the book “International Handbook on Commercial Arbitration” (Kluwer 1996, 2002 and 2011 Supplements) and the regular contributor to the “Annual Review of Singapore” chapter on “Arbitration” since 2001. His papers have also been published in various international journals including the Journal of International Arbitration, Asian International Arbitration Journal, Asia Business Law Review, Chinese Yearbook of Private International and Comparative Law (Peking University Press), Dispute Resolution Journal (London) and the Asian Business Lawyer (Korea University). He is on the editorial board of the Oxford International Arbitration Series, (Oxford University Press) and a General Editor of the Asian International Arbitration Journal. 

The “UNCITRAL Digest on the Model Law on International Commercial Arbitration 2012” is his latest published work which he completed (with Prof Frederic Bachand and Dr Stefan Kroll) in July 2012. 

Consistently ranked as one of Asia’s most “in demand” “leading individuals” in international arbitration from 2008 to 2013, Prof Boo has sat as arbitrator in more than 200 cases in many jurisdictions and written numerous awards. He has recently been designated by Singapore to serve on the ICSID Panel of Arbitrators. 

About the Chairperson: 

Mr. Ganesh Chandru specialises in International Arbitration and Dispute Resolution, and is admitted to practice in Singapore, England and India. He is a Fellow of the Singapore Institute of Arbitrators and the Chartered Institute of Arbitrators. 

His practice encompasses advising and representing parties in arbitrations (under Rules of SIAC, ICC, LCIA, SCMA, UNCITRAL as well as ad hoc) and in litigation matters before the Courts. Ganesh also sits as an arbitrator in international arbitrations. He is a member of the Panel of Arbitrators of SIAC, Singapore Institute of Arbitrators and the KLRCA. He is on the Council of the Singapore Institute of Arbitrators and currently chairs one of its committees.

Between 2002 and 2007, Ganesh was the Counsel & Assistant Registrar of the SIAC. He supervised the administration of about 500 arbitrations during his 5-year stint at SIAC. He also pioneered SIAC’s initiatives in India.

Ganesh regularly speaks on arbitration and has lectured at the International Entry Course on Arbitration Law & Practice conducted by the Singapore Institute of Arbitrators and the Chartered Institute of Arbitrators. He is a co-author of the Singapore Chapter in 'The International Comparative Legal Guide to International Arbitration' (4th Edition, 2007). He has been recognised in the ‘Global Arbitration Review 100 (2009)’ as a “significant” name.
