About this Seminar:-

For commercial arbitrations to be successfully adopted and favoured, there must be accommodation on the part of the courts. The courts of the relevant jurisdiction must not see it as an ‘ouster of its jurisdiction’ and indeed must accommodate it as part of the legal landscape within its jurisdictional purview. To that end, an important aspect is the court’s willingness to stay its own proceedings in favour of arbitration where a claimant has filed suit in court in ostensible violation of its contractual obligations to arbitrate. The scope and mechanics of the stay provisions of any arbitration statute is therefore worthy of study. This is so in the case of section 6 of both the Arbitration Act (Cap 10) and the International Arbitration Act (Cap 143A). This brief presentation seeks to examine these elements of the stay provisions in both arbitration statutes in Singapore.

About the Speaker:  

Leslie Chew SC is a practicing lawyer of more than 26 years. After practicing at the Bar for 26 years, Leslie was appointed a District Judge in 2007 and Senior District Judge in 2009. After spending almost 7 years in the judiciary, he returned to private practice in May 2014. He was appointed a Senior Counsel in 2000. He is a Professorial Fellow of the Singapore Institute of Legal Education where he teaches the Law and Practice of Arbitration as part of the Bar Examinations. He is a Fellow of the Chartered and Singapore Institutes of Arbitrators as well as a Fellow of the Australian Centre for International Commercial Arbitration (ACICA). Leslie has sat both as a sole Arbitrator and as part of a tribunal in ICC, SIAC and ad hoc arbitrations both in Singapore and abroad. He is the author of the ‘Law and Practice of Arbitration in Singapore’ (LexisNexis, 2010). Leslie has also taught advocacy to the local Bar as well as lawyers in other jurisdictions for many years. He was one of the early Singapore lawyers to train with the National Institute of Trial Advocacy (NITA) in the USA. More recently, he was part of the faculty in the Singapore Advanced Advocacy Course 2014, which is modeled on the International Advanced Advocacy Course, Keeble College, Oxford.  

About the Chairperson: 

A founding partner of LT&T Architects, Johnny now specialises in the area of alternative dispute resolution (ADR), especially arbitration. He is a Past President of the Singapore Institute of Arbitrators (SIArb), having served two terms as President from 2007 to 2011. Johnny is a member of the panel of arbitrators of Singapore International Arbitration Centre (SIAC), Singapore Institute of Arbitrators (SIArb), Kuala Lumpur Regional Centre for Arbitration (KLRCA), Hong Kong International Arbitration Centre (HKIAC), Dubai International Arbitration Centre (DIAC), South China International Economic and Trade Arbitration Commission/Shenzhen Court of International Arbitration (SCIA), London Court of International Arbitration (LCIA), Indian Institute of Arbitrators and Mediators (IIAM) and Singapore Institute of Architects (SIA). An accredited adjudicator with the Singapore Mediation Centre (SMC), Johnny also sits on the Construction Adjudicator Accreditation Committee (CAAC). Johnny has held various positions in the Singapore Institute of Architects (SIA) and served as its Vice-President from 1998 to 2000. He has been extensively involved in the drafting of the SIA Standard Conditions of Contract (5th to 9th Edition), including making it SOPA compliant. Johnny has been appointed as arbitrator in both institutional and ad hoc arbitration cases in Singapore, Brunei and Dubai. He has also been appointed as adjudicator as well as review adjudicator in several adjudication applications. In addition to an active practice in architecture and ADR, Johnny also sits on the Board of Governors of Singapore Polytechnic and chairs the School of Architecture and the Built Environment Advisory Committee and the Admin and Development Committee. He is Chairman of the SP International Board. Besides being a frequent speaker on construction and dispute resolution at both local and international conferences and seminars, Johnny conducts specialised training in these areas for government agencies, professional associations and the private sector both in Singapore and overseas.
