About the Seminar:
Singapore’s arbitration scene continues to buzz in 2018, staring with the announcement by the ICC Court of its setting up of its case handling office at Maxwell Chambers and the subsequent announcement by SIAC of its unprecedented caseload increase, placing SIAC way ahead of regional institutions and making Singapore the third most preferred seat in the world.
Singapore courts too have an active docket for applications for stay, review of tribunal’s rulings on jurisdiction and the setting aside and enforcement of awards.
The speakers will share their observations and insights on many of the judicial decisions made by the courts in 2018. These will include the courts’ application of Section 10A of International Arbitration Act (“IAA”) and its interplay with Art 16 of UNCITRAL Model Law (as set out in Schedule 1 of the IAA) in the review of tribunal’s jurisdictional decisions (such as Rakna Arakshaka Lanka Ltd v Avant Garde Maritime Services (Private) Limited [2018] SGHC 78 ), and the question as to whether a challenge to the tribunal’s preliminary ruling was not a “one-shot remedy” and would not affect the availability of challenge it under the setting aside or enforcement stage. The Court of Appeal decision in Marty Ltd v Hualon Corp (Malaysia) Sdn Bhd [2018] SGCA 63 as to whether the commencement by a party of court proceedings in another forum would constitute a repudiatory breach disentitling the party from commencing or continuing action will also be considered. The speakers will also share their views and observations on the treatment by the Hong Kong Court of Final Appeal ([2018] HKCFA 12) of the Singapore Court of Appeal’s decision in PT First media TBK v Astro Nusantara International BV and others [2013] SGCA 57 and its implications on what and how courts in enforcement jurisdictions should deal with such applications.

About the Speakers:

Adrienne 1 
Professor Lawrence Boo is the author of “Halsbury’s Laws of Singapore Volume 1(2) - Arbitration” (Lexis-Nexis 2017 Re-issue) and the regular contributor to the “Annual Review of Singapore” chapter on “Arbitration” since 2001. His papers have also been published in various international journals including the Journal of International Arbitration, Asian International Arbitration Journal, Asia Business Law Review, Chinese Yearbook of Private International and Comparative Law (Peking University Press), Dispute Resolution Journal (London) and the Asian Business Lawyer (Korea University). He is on the editorial board of the Oxford International Arbitration Series, (Oxford University Press). He teaches international commercial arbitration at NUS Law and at Bond University School of Law.
 
Adrienne 1 
Ms Christine Artero is a full-time arbitrator, Resident at The Arbitration Chambers (Singapore) and Door Tenant of Fountain Court Chambers (London and Singapore). She is dual-qualified lawyer having been admitted to the Paris Bar and as a solicitor in England and Wales. Ms Artero has extensive experience in international arbitration, and a substantial practice in Asia and in Europe. Prior to launching her career as independent arbitrator, she worked at Shearman & Sterling in London and thereafter served as counsel at the London Court of International Arbitration (LCIA). In 2014, Christine moved to Singapore where she joined The Arbitration Chambers, and was appointed Tribunal Secretary to over 80 arbitral tribunals under all major arbitral institutions. Ms Artero is also an adjunct professor at the University of Toulouse 1 (France), teaching international arbitration.
 

About the Chairperson:

 francisgoh Mr. Francis Goh is an equity partner of Eversheds Harry Elias LLP. He is the head of the firm’s International Arbitration Practice and he also leads the firm’s Private Client practice. He graduated from the National University of Singapore in 1990 and has since been in active legal practice for 25 years. Francis is a fellow of the SIArb and currently serves on the SIArb Council. Francis is also a Principal Mediator with the Singapore Mediation Centre. His background in litigation and commercial disputes resolution gives Francis a distinct advantage in negotiations, advising on commercial contracts and corporate governance. Francis is well placed to guide companies and business owners to manage their risk, processes as well as business succession issues.
