The arbitration of disputes relating to intellectual property rights is a subject which lies at the intersection of two rapidly growing disciplines of the law today. Arbitration is increasingly chosen as a means of resolving commercial disputes, particularly those which transcend national boundaries. Intellectual property rights have increasingly spawned disputes between multinational corporations and even governments and a principal reason for this is that the rights are often exploited on a global rather than a national basis. The purpose of the talk is to examine some of the major aspects of the intersection between these two disciplines. 

About the speaker:

Tan Tee Jim, S.C. has been involved in intellectual property (IP) law for 30 years. He has appeared in numerous IP court cases, many of which have become landmarks in the 10cailP law (such as Singapore Broadcasting Corporation v PRS, COL Hotels v Pontiac, Genelabs v Institut Pasteur, McDonald's v Future Enterprise, Amanresorts v Novelty and City Chain v Louis Vuitton). He has been very active in a number of local and international IP organizations, such as the Association of Singapore Patent Agents (ASPA) where he is the immediate past President, the Asian Patents Attorney Association (APAA) where he was a Vice-President, the ASEAN Intellectual Property Association where he is a founding council member and International Trademark Association where he is currently in the Emerging Issues Committee. He is also a member of the Singapore Copyright Tribunal and a member of the panel of arbitrators of the World Intellectual Property Organisation and the Singapore International Arbitration Centre for domain name disputes. He has presented papers at numerous local and international conferences on various IP issues. He has also written extensively and is the author of the book entitled "Law of Trade Marks and Passing Ofr in Singapore", now in its second edition. Tee Jim has been regularly cited as a leading IP lawyer in Singapore and Asia by various legal publications including The Asia Pacific Legal 500, Global Counsel 3000 and Global Counsel's Intel/ectual Property Handbook. He has also been noted by Euromoney Legal Media Group's Guide to the World's Leading Trade Mark Law Practitioners as a leading practitioner in this field. 

About the Chairman

Mr. Ho Cheng Huat is the Director of Singapore's IP Academy since September 2007, a national initiative dedicated to developing and broadening of Singapore's knowledge and capabilities in Intellectual Property (IP) protection, management, and exploitation. Concurrently, he is an Executive Vice President of Exploit Technologies Pte. Ltd., the marketing and commercialisation arm of Singapore's Agency for Science, Technology and Research (A'STAR). In the latter capacity, he oversees a team of IP Management Officers to manage A'STAR's patent portfolio. Mr. Ho started his career as a radiofrequency development engineer in the Singapore subsidiary of a US multinational. In 1994, he joined the IP profession and, after legal & IP training and education, became a patent attorney in the Asia-Pacific IP Law Department of that US multinational. Subsequently, he worked as a patent agent in two Singapore patent firms. He joined Exploit Technologies Pte. Ltd in November 2002. As a patent practitioner from 1994 to 2002, Mr. Ho drafted, filed, and prosecuted Singapore and international patent applications for local and overseas clients.
