About the Seminar:

This talk discusses the approach of the courts in three jurisdictions with respect to the enforcement of foreign awards under the New York Convention; in particular, whether their analysis of who constitutes a party to an arbitration agreement under the Convention is uniform. The seminal cases which will be discussed are: Aloe Vera of America, Inc v Asianic Food (S) Pte Ltd and another [2006] 3 SLR(R) 174 (Singapore), Dallah Real Estate and Tourism Holding Company v The Ministry of Religious Affairs, Government of Pakistan [2010] UKPC 46 (UK), and IMC Aviation Solutions Pty Ltd v Altain Khuder LLC [2011] VSCA 248 (Australia).

About the Speaker:

Dinesh Dhillon is a partner in Litigation and Dispute Resolution at M/s Allen & Gledhill. His areas of practice encompass litigation, international arbitration, international trade, insurance and employment law. He has successfully argued cases at all levels of Court in Singapore including its highest court, the Court of Appeal. He has acted for parties in various ICC and SIAC arbitrations. Dinesh is recommended for his expertise in arbitration and commercial litigation and dispute resolution in leading publications, such as The Asia Pacific Legal 500 where he is described as “outstanding”.

Cases where Dinesh has represented and advised clients include the following:

  • acted in an SIAC arbitration for a major European airline in relation to a claim for approximately 20 million Euros by its Indonesian joint venture partner over the provision of IT services;
  • acted for a government in successfully resisting the setting aside of an ICC award involving the construction of an airport terminal where the value of the dispute was approximately US$1.4 billion;
  • successfully represented a US based multi-national corporation in the landmark Aloe Vera of America, Inc v Asianic Food High Court decision regarding the enforcement of a New York Convention foreign arbitral award against a non-signatory to the arbitration agreement; and
  • represented a leading international sports promoter in an application to set aside an International Arbitral Award on grounds of public policy before the Court of Appeal (AJU v AJT). This case won the Asian-MENA Counsel’s Deal of the Year award for 2011.

About the Chairperson:

Edwin Lee, a founding partner of Eldan Law LLP, has advised and acted for government authorities, developers, contractors, and consultants on numerous aspects of building contract law in many cases in court and arbitrations. He has advised on local and overseas projects and these include joint ventures, consortium arrangements, and the review and drafting of numerous contracts for engineering, infrastructure and building works. He has acted as counsel in numerous adjudications, and has also sat as both an adjudicator and as a review adjudicator to hear adjudication reviews. 

He is currently an Adjunct Assistant Professor with the National University of Singapore, and also lectures on Building Contract Law at the Singapore Institute of Management for a degree programme on project management administered by the Royal Melbourne Institute of Technology. Edwin is also the author of the book, Building Contract Law in Singapore, a co-author of Law & Practice of Injunctions in Singapore, and co-author of Confidentiality in Arbitration, and one of the general editors of Singapore Construction Adjudication Review.
