Applications are invited for participation in the International Entry Course. Candidates who pass the Course may, subject to satisfying other relevant criteria, qualify for admission as a Member of the Singapore Institute of Arbitrators.
SYNOPSIS OF THE COURSE
The International Entry Course consists of 4 Modules conducted over two full days (18 and 19 May 2012). Each Module covers a particular segment of arbitration law and practice. Module 1 gives an overview of arbitration and introduces key concepts like “seat” and lex arbitri. Module 2 covers the commencement of arbitration and the constitution of the tribunal. Module 3 goes into the arbitration procedure, from statements to the substantive hearing. Module 4 discusses the award, and the further steps that may be taken to challenge or enforce the award. Details of each module are attached (Appendix 1).
A candidate may apply to sit for only some of the Modules, although only successful completion of all the course modules (with 100% attendance) and assessments will lead to qualification for membership as Member of SIArb, subject to the qualifying requirements (for example, applicants for membership must be at least twenty-five (25) years old at the date of application).
COURSE DIRECTOR AND LECTURER
Mr. Naresh Mahtani has been in legal practice for 30 years in dispute resolution, commercial transactions, construction and oil & gas projects. He was founding partner of ATMD Bird & Bird LLP, where he is now a practising consultant for projects and dispute resolution. He was Chairman of the Society of Construction Law, Singapore (2006-2008) and is a council member of SIArb. He has been counsel in various domestic and international arbitrations and litigations in Singapore and the region; and appointed as arbitrator in institutional and ad hoc arbitration cases. He is on the SIAC, KLRIAC, DIAC and several other international arbitration panels; on the Disputes Resolution Panel of Singapore Wholesale Electricity Market; Adjudicator with Financial Industry Dispute Resolution (FidreC), as well as Adjudicator and Associate Mediator with the Singapore Mediation Centre. He has written widely and been a speaker at various conferences on subjects relating to arbitration, expert determination and other progressive forms of ADR, and has lectured and tutored at the SIArb IEC and Fellowship courses for several years.
COURSE LECTURERS
Mr. Mohan R Pillay is President of the Singapore Institute of Arbitrators & a Singapore and UK qualified disputes lawyer with 25 years experience in commercial litigation and regional arbitration work. He is the Joint Head of Pinsent Masons MPillay LLP, a Singapore Joint Law Venture and Managing Partner of the Singapore constituent practice of MPillay. His main areas of practice are commercial & corporate disputes, professional negligence, building & civil engineering contracts, and arbitration. Mohan is a Chartered Arbitrator & accredited Adjudicator, and on Panels of SIAC, SIArb and KL Regional Centre for Arbitration. He is currently Vice Chair, Dispute Resolution Committee, IPBA. His teaching appointments have included Adjunct Associate Professor, Faculty of Law, National University of Singapore (2003 – 2011) and Visiting Professor, Centre of Construction Law, King’s College London (2005 – 2011).
Mr. Johnny Tan Cheng Hye, PBM is the founding partner of LT&T Architects. He is the Immediate Past President of the Singapore Institute of Arbitrators (SIArb) having served as the President from 2007 to 2011. Johnny is a member of the panel of arbitrators of SIAC, KLRCA, HKIAC, DIAC, SIArb, AABD and SIA. Johnny is an accredited adjudicator with the Singapore Mediation Centre (SMC) where he also sits on the Construction Adjudicator Accreditation Committee (CAAC). Johnny has also held various positions in the Singapore Institute of Architects and served as its Vice-President from 1998 to 2000. He has been extensively involved in the drafting of the SIA Standard Conditions of Contract (5th to 9th Edition) including making it SOPA compliant. Johnny has been appointed as arbitrator in both institutional and ad hoc arbitration in Singapore, Brunei and Dubai. He has also been appointed as adjudicator as well as review adjudicator in several adjudication applications. In addition to an active practice in architecture and alternative dispute resolution, Johnny also sits on the Board of Governors of the Singapore Polytechnic and chairs its School of Architecture and the Built Environment Advisory Committee. Johnny is a frequent speaker on construction and arbitration subject at both local and international conferences.
Mr. Dinesh Dhillon is a partner in Litigation and Dispute Resolution at M/s Allen & Gledhill. His areas of practice encompass litigation, international arbitration, international trade, insurance and employment law. He has successfully argued cases at all levels of Court in Singapore including its highest court, the Court of Appeal. He has acted for parties in various ICC and SIAC arbitrations. Dinesh is recommended for his expertise in arbitration and commercial litigation and dispute resolution in leading publications, such as The Asia Pacific Legal 500 where he is described as “outstanding”. Some of Dinesh's major cases include the landmark Aloe Vera of America, Inc v Asianic Food High Court decision regarding the enforcement of a New York Convention foreign arbitral award against a non-signatory to the arbitration agreement; and AJU v AJT, which won the Asian-MENA Counsel’s Deal of the Year award in 2011.
