Singapore Arbitral Scene – Are We Setting The Pace?

About the Seminar:

2012 will easily be remembered for being one of the most exciting years for arbitration in Singapore. ICCA Singapore Congress achieved a record number of 1,059 attendees. The arbitration scene continues to be vibrant in Singapore. SIAC’s case numbers have seen a significant increase. The International Arbitration Act was amended to give effect to the new regime of “emergency arbitrators”, a wider scope for judicial review of jurisdictional decisions, and adopt a broader definition of the “writing requirement” for arbitration agreements. Singapore courts too have had a busy and exciting year delivering many decisions impacting arbitration. The speaker will share his observations of the legislative changes made and his insights on some of judicial decisions delivered by the courts, in particular those relating to the exercise of judicial recourse against decisions and awards made by arbitral tribunals. Notable decisions deserving comment will include the Court of Appeal’s decision in PT Prima International Development v Kempinski Hotels SA and other appeals [2012] SGCA 35, L W Infrastructure Pte Ltd v Lim Chin San Contractors Pte Ltd [2012] SGCA 57 and the highly publicized case of Astro Nusantara International BV and others v PT Ayunda Prima Mitra and others [2012] SGHC 212. He will also highlight some recent decisions from other Model Law jurisdictions on recourse against or the enforcement of arbitral awards for a better understanding of the different judicial approaches adopted in the implementation of Model Law.

About the Speaker: 

Prof Lawrence Boo is the author of “Halsbury’s Laws of Singapore Volume 1(2) - Arbitration” (Lexis-Nexis 2011 Re-issue), the chapter on Singapore in the book “International Handbook on Commercial Arbitration” (Kluwer 1996, 2002 and 2011 Supplements) and the regular contributor to the “Annual Review of Singapore” chapter on “Arbitration” since 2001. His papers have also been published in various international journals including the Journal of International Arbitration, Asian International Arbitration Journal, Asia Business Law Review, Chinese Yearbook of Private International and Comparative Law (Peking University Press), Dispute Resolution Journal (London) and the Asian Business Lawyer (Korea University). He is on the editorial board of the Oxford International Arbitration Series, (Oxford University Press) and a General Editor of the Asian International Arbitration Journal. The “UNCITRAL Digest on the Model Law on International Commercial Arbitration 2012” is his latest published work which he completed (with Prof Frederic Bachand and Dr Stefan Kroll) in July 2012. 

About the Chairman: 

Dinesh Dhillon is a Partner in Litigation & Dispute Resolution. His areas of practice encompass litigation, international arbitration, international trade, insurance and employment law. He has successfully argued cases at all levels of Court in Singapore including its highest court, the Court of Appeal. Dinesh is a Fellow and Council Member of the Singapore Institute of Arbitrators. He has contributed the Singapore chapter for International Commercial Dispute Resolution (Tottel Publishing Ltd, 2009). Dinesh was called to the Singapore Bar in 1995. In 2004, Dinesh obtained the Graduate Certificate in International Arbitration from the National University of Singapore. Dinesh is recommended for his expertise in arbitration and commercial litigation and dispute resolution in leading publications, such as The Asia Pacific Legal 500 where he has been described as “outstanding.
