About this Seminar:-

The availability of interim relief within the context of arbitration proceedings and the availability of interim relief in support of arbitration proceedings are increasingly important weapons in the armoury of a litigant. 

In this presentation, Sara Masters QC of 20 Essex Street will consider:

  • The scope of interim relief, including the different forms of interim relief that arbitral tribunals may order, and the circumstances in which such relief is available; 
  • What law, laws or principles of law should apply to or guide an arbitral tribunal (or emergency arbitrator) in exercising procedural discretion whether to grant interim relief; 
  • What considerations should inform decisions on where and from whom to seek interim relief, and what, in practice, are the strengths and weaknesses of tribunal-ordered (rather than court-ordered) interim measures; 
  • How should tribunals balance the need for swift action, and effective remedies, with the requirements of procedural fairness;
  • The enforcement of interim relief, and judicial support for additional remedies; and
  • Recent developments under English law.

Matthew Shaw, a senior member of the White & Case international arbitration team in Singapore, will moderate a Q&A and discussion of issues arising from the presentation.

About the Speaker: 

Sara specialises in all areas of commercial law. She has a particular interest in jurisdictional disputes, including jurisdictional issues arising in arbitration, and conflicts of laws problems and is the current European editor of The White Book. She also has extensive experience in insurance and reinsurance, sale of goods, shipping and commodities, construction, energy and European Union law. She has appeared in the High Court, the Court of Appeal, the House of Lords, and the Privy Council and before the European Court of Justice. She also appears frequently before arbitrators in a broad range of disputes both in the UK and abroad. She accepts appointments as an arbitrator both in international trade and shipping matters and in commercial disputes more generally, and is also a CEDR accredited mediator. Sara is recommended as a leading "new silk" in the fields of Commercial Litigation, Commodities, International Arbitration, and Shipping by The Legal 500 2012, and by Chambers and Partners in the Shipping & Commodities category where she is described as a ‘clear favourite with instructing solicitors'. Prior to taking silk she was listed as a Leading Junior for Shipping and Commodities in Chambers and Partners (UK Guide 2012) where she is described as "persuasive and possessed of a great ability for presentation", she was also recommended in the Legal 500 (2011) for Commercial Litigation, Commodities and International Arbitration. She was named by The Lawyer magazine as one of the "Hot 100" for 2009. 

About the Chairman: 

Matthew Shaw is a senior associate in the international arbitration practice at White & Case in Singapore. He specializes in international arbitrations in the power, oil and gas, telecoms and infrastructure sectors, in addition to general commercial disputes involving M&A transactions, joint ventures and other shareholder disputes. He is familiar with conducting arbitrations under the ICC, SIAC, UNCITRAL and VIAC rules, and regularly acts for clients both in an advisory capacity and as counsel before arbitral tribunals.
