About this Seminar:-

With the launch of various initiatives that have fortified Singapore’s reputation as a hub for dispute resolution, it is expected that the arbitration of cross-border IP disputes will increase over the next few years. IP disputes present a unique set of challenges for arbitration. One of these challenges is the arbitrability of IP disputes that include a claim for invalidity or revocation. What are the limits of the jurisdictional powers of arbitral tribunals in this area? Another pertinent challenge relates to the inherent difficulty of recognizing and enforcing foreign arbitral awards that contain findings of invalidity of Singapore-registered IP rights. This seminar presents a perspective on the extent to which these challenges are recognized and resolved, as well as the opportunities that lie ahead for practitioners in this area.

About the Speaker: 

Dr Stanley Lai SC specialises in all forms of IP litigation/Information Technology disputes. He is also a commercial litigator. Stanley maintains a strong advisory practice for IP management and strategy, serving a broad spectrum of clients. Stanley has appeared as counsel in many reported IP decisions of the Singapore Courts. He was appointed Senior Counsel in 2010 and currently heads the Intellectual Property Practice of Allen & Gledhill LLP.

Stanley is currently the Chairman of the Intellectual Property Office of Singapore. He is also a member of the Singapore Copyright Tribunal and sits as a director of Singapore Technologies Engineering Ltd (SGX-Listed). He holds the appointment of Adjunct Associate Professor of the Faculty of Law, National University of Singapore. In the area of alternative dispute resolution, Stanley is a Principal Mediator of the Singapore Mediation Centre, focusing on IP/IT disputes. He also serves on the panel of IP Arbitrators in the Singapore International Arbitration Centre. Stanley was the first Singapore-born lawyer to be conferred a doctorate from the University of Cambridge in 1999.  

About the Chairperson:  

Mr Goh Phai Cheng SC, has sat as sole arbitrator, co-arbitrator and chairperson in institutionally administered arbitrations conducted under arbitration rules of ICC, SIAC, UNCITRAL and as sole arbitrator in ad hoc arbitrations. He has served as mediator in more than 150 mediations and is an accredited mediator with the Singapore Mediation Centre and the International Mediation Organization. He has also been appointed as an adjudicator for payment disputes under the Building Construction Industry (Security of Payment) Act.

Mr Goh started his legal career as a legal officer and later as a legislative draftsman in the Attorney General's Chambers. He was the draftsman of Singapore's Copyright Act which was enacted in 1986 and later served as the first President of the Singapore Copyright Tribunal. He had served as President of the Singapore Industrial Arbitration Court and Judicial Commissioner, Supreme Court of Singapore.
