The Singapore Institute of Arbitrators (SIArb) is pleased to announce that the annual International Entry Course is now open for registrations. Candidates who pass the Course may, subject to satisfying other relevant criteria, qualify for admission as a Member of the Singapore Institute of Arbitrators.

SYNOPSIS OF THE COURSE

The International Entry Course consists of 4 Modules conducted over two full days (24 & 25 April 2015). Each Module covers a particular segment of arbitration law and practice. Module 1 gives an overview of arbitration and introduces key concepts like “seat” and lex arbitri. Module 2 covers the commencement of arbitration, constitution of the tribunal and issues concerning jurisdiction. Module 3 goes into the arbitration procedure, from statements to the substantive hearing. Module 4 discusses the award, and the further steps that may be taken to challenge or enforce the award.

A candidate may apply to sit for only some of the Modules. Successful completion of all the course modules (with 100% attendance) and assessments will lead to qualification for membership as Member of SIArb, subject to the qualifying requirements. 

COURSE DIRECTOR:

Mr. Naresh Mahtani has been in legal practice for 30 years in dispute resolution, commercial transactions, construction and oil & gas projects. He was founding partner of ATMD Bird & Bird LLP and is currently a partner of Eldan Law LLP with an active practice in projects and dispute resolution. He was Chairman of the Society of Construction Law, Singapore (2006-2008) and is Honorary Secretary of SIArb. He has been counsel in various domestic and international arbitrations and litigations in Singapore and the region; and appointed as arbitrator in institutional and ad hoc arbitration cases. He is on the SIAC, ICC and several other international arbitration panels; on the Disputes Resolution Panel of Singapore Wholesale Electricity Market; Adjudicator with Financial Industry Dispute Resolution (FidreC), as well as adjudicator and mediator with the Singapore Mediation Centre. He has written widely and been a speaker at various conferences on subjects relating to arbitration, expert determination and other progressive forms of ADR, and has lectured and tutored at the SIArb IEC and Fellowship courses for several years.  

LECTURERS:

Mr. Mohan Pillay is the Managing Partner of the Singapore law firm MPillay and Joint Head of Office of the Singapore Joint Law Venture of Pinsent Masons MPillay LLP. He is a Singapore and UK qualified dispute resolution lawyer with over 25 years’ experience in advisory, commercial litigation and regional arbitration work, particularly in construction and engineering projects. Mohan is a Chartered Arbitrator and the first Review Adjudicator appointed under the adjudication regime in Singapore. He has acted as Arbitrator (both sole and presiding) and Mediator in a number of matters, both domestic and international. He is the Immediate Past President of the Singapore Institute of Arbitrators, and Vice Chair of the Dispute Resolution & Arbitration Committee, Inter-Pacific Bar Association (IPBA). His recent past appointments include being Past Chair of both SCL (Singapore) and the International Construction Projects Committee, IPBA, as well as teaching appointments as Adj. Assoc. Professor at the Faculty of Law, National University of Singapore (2003 - 2011) and Visiting Professor at the Centre of Construction Law & Dispute Resolution, King’s College London, University of London (2005 – 2011). He is also one of the General Editors of Singapore Construction Adjudication Review.

Mr. Kelvin Aw is a well-regarded projects lawyer. He has diverse experience ranging from front-end structuring and procurement work to backend contentious work arising from construction, engineering and infrastructure projects in Asia. He has acted as project counsel for several landmark developments, including one of the largest integrated resort developments in Singapore exceeding S$6 billion. Regionally, he has also been sought for his advice on notable project developments in China, India and the Middle East. He has produced several in-house standard contracts and operational guides for developers and constructors alike. On contentious work, Kelvin frequently represents developers and constructors in statutory adjudications under the Building and Construction Industry Security of Payment Act (Cap. 30B) and arbitrations. He is a fellow of the Singapore and Chartered Institutes of Arbitrators, and an accredited adjudicator with the Singapore Mediation Centre. Kelvin is a graduate of the MSc (Construction Law & Arbitration) programme at King’s College London and has taught Construction Law modules at the National University of Singapore. He currently sits on the Council of the Singapore Institute of Arbitrators.  

Mr. Johnny Tan Cheng Hye, BBM is the founding partner of LT&T Architects. A Past President of the Singapore Institute of Arbitrators (SIArb), having served two terms as President from 2007 to 2011, he now specialises in the area of alternative dispute resolution (ADR), especially arbitration. Johnny is a member of the panel of arbitrators of SIAC, SIArb, KLRCA, HKIAC, DIAC, SCIA, LCIA, IIAM and SIA. Johnny is an accredited adjudicator with the Singapore Mediation Centre (SMC) where he also sits on the Construction Adjudicator Accreditation Committee (CAAC). Johnny has also held various positions in the Singapore Institute of Architects and served as its Vice-President from 1998 to 2000. He has been extensively involved in the drafting of the SIA Standard Conditions of Contract (5th to 9th Edition), including making it SOPA compliant. Johnny has been appointed as arbitrator in both institutional and ad hoc arbitration cases in Singapore, Brunei and Dubai. He has also been appointed as adjudicator as well as review adjudicator in several adjudication applications. In addition to an active practice in architecture and ADR, Johnny also sits on the Board of Governors of Singapore Polytechnic and chairs the School of Architecture and the Built Environment Advisory Committee and the Admin and Development Committee.  

Mr. Steven Lim is the Managing Director of Clasis LLC and a Partner with Clyde & Co Clasis Singapore. Steven has more than 20 years' experience in disputes, particularly in arbitration, construction, shipbuilding, energy and oil and gas cases. He has represented clients in large and complex international arbitrations before several arbitral institutions, including the ICC, LCIA and SIAC and under the UNCITRAL rules. Steven also sits as an arbitrator. He is a member of the ICDR's International Panel of Arbitrators, the SIAC Panel of Arbitrators and the KLRCA Panel of International Arbitrators and sits as an arbitrator for ICC cases. Steven has been appointed an emergency arbitrator by the SIAC. He is a fellow of the Singapore Institute of Arbitrators. Steven has experience with a broad range of commercial disputes covering private equity investments and M&A, banking, insolvency, hotel management, trading contracts, oil and gas and energy, offshore services and engineering, ship building and construction. In the construction field, he has worked on building and engineering cases, including power, petroleum and petrochemical, road and rail and water management projects. Steven has received recognition as a leading individual in international arbitration and in international dispute resolution in Singapore, Hong Kong and Asia-wide in the Chambers Global and Chambers Asia directories.
