About this Seminar

Arbitrators are obliged decide a dispute in accordance with the rules of law chosen by the parties or as determined in accordance with conflict of law rules. Unless otherwise agreed by the parties, arbitrators are not permitted to decide ex aequo et bono or as amiable compositeur. Yet, there is no corresponding basis under Singapore law (and in most jurisdictions) that would permit parties to meaningfully enforce this obligation.

Does this incongruence in the architecture of international commercial arbitration create a moral hazard in which tribunals may in fact determine questions of law in accordance with their own sense of justice? If so, what, if anything, should be done about it?

About the Speaker

Paul Tan

 

Mr. Paul Tan – Partner, Gibson, Dunn & Crutcher LLP

Mr. Paul Tan is a partner in the Singapore office of Gibson, Dunn & Crutcher LLP.  Mr. Tan specialises in international arbitration (both commercial and investor state), international litigation and arbitration-related litigation.  He leads the arbitration practice for the firm in Asia.

Mr. Tan is described as “one of the best lawyers in Singapore”. In addition to his work as counsel, he has been appointed an expert on Singapore law, and sits as an arbitrator in SIAC and ICC cases.

He is also the co-author of: The Law and Theory of International Commercial Arbitration in Singapore (Academy Publishing, 2022),  A Commentary on the Singapore International Arbitration Act (Oxford University Press, 2023); the forthcoming edition of Mustill & Boyd’s treatise on commercial and investment arbitration; and Singapore Law: 50 Years in the Making (2017).

Mr. Andrew Pullen – Barrister, Fountain Court Chambers; Vice-Chair, Singapore Institute of Arbitrators

Mr. Andrew Pullen is an English-qualified barrister specialising in international arbitration, appearing as counsel and sitting as arbitrator. He has been based in Singapore since 2011. Andrew’s recent cases range from construction disputes in Australia and Asia, to claims relating to software licensing and the development of pharmaceuticals, to joint venture disputes.

His diverse experience covers energy, finance, mining, automotive, defence, utilities, heavy industry, manufacturing, brewing and media, and cases determined under a wide variety of governing laws and arbitral rules, in Asia, Europe and the US. He frequently works as co-counsel with lawyers from many jurisdictions and has considerable experience of interim measures and jurisdiction issues in arbitration.
