SYNOPSIS OF THE COURSE

The International Entry Course consists of 4 Modules conducted over two full days (12 and 13 November 2010). Each Module covers a particular segment of arbitration law and practice. Module 1 gives an overview of arbitration and introduces key concepts like “seat” and lex arbitri. Module 2 covers the commencement of arbitration and the constitution of the tribunal. Module 3 goes into the arbitration procedure, from statements to the substantive hearing. Module 4 discusses the award, and the further steps that may be taken to challenge or enforce the award. Details of each module are attached (Appendix 1). A candidate may apply to sit for only some of the Modules, although only successful completion of all the course modules (with 100% attendance) and assessments will lead to qualification for membership as Member of SIArb, subject to other requirements. For example, candidates must be at least twenty-five (25) years old at the date of application for membership. 

COURSE DIRECTOR

CHAN LENG SUN – BRIEF PROFILE

Mr. Chan Leng Sun is admitted to practice in Malaysia, Singapore and England. He has been a partner in Ang & Partners since 1995. Leng Sun chairs the ADR Committee of the Singapore Law Society and the Education Committee of the Singapore Institute of Arbitrators. He is a Fellow of the Singapore Institute of Arbitrators, the Chartered Institute of Arbitrators and the Malaysian Institute of Arbitrators. Leng Sun sits as an arbitrator and adjudicator on the panel of various institutions, such as the Singapore International Arbitration Centre, the Financial Intermediaries Disputes Resolution Centre (FIDReC), the Income Tax Board of Review and the Maintenance of Parents Tribunal. Leng Sun is Adjunct Faculty for International Commercial Arbitration at the SMU School of Law. He previously taught at the NUS Law Faculty and served with the United Nations Compensation Commission in Geneva. He was also a CIAC-SIAC Observer to the UNCITRAL Working Group on Arbitration. Leng Sun’s papers have been published in numerous international journals and cited in leading references such as Arnould’s Marine Insurance (2008 ed.). He is Country Commentator for Singapore in Tetley’s Marine Cargo Claims (4th ed).

COURSE LECTURERS

Mr. Naresh Mahtani has been in legal practice for over 28 years in dispute resolution, commercial transactions, construction and oil & gas projects. He was founding partner of ATMD Bird & Bird LLP, where he is now a practising consultant for projects and dispute resolution. He was Chairman of the Society of Construction Law, Singapore (2006-2008) and council member of SIArb (2006-2008). He has been counsel in various domestic and international arbitrations and litigations in Singapore and the region; and appointed as arbitrator in institutional and ad hoc arbitration cases. He is on the SIAC and several other international arbitration panels; on the Disputes Resolution Panel of Singapore Wholesale Electricity Market; Adjudicator with Financial Industry Dispute Resolution (FidreC), as well as Adjudicator and Associate Mediator with the Singapore Mediation Centre. He has written widely and been a speaker at various conferences on subjects relating to dispute resolution, expert determination of disputes, arbitration and progressive forms of ADR, and has lectured at the SIArb IEC and Fellowship courses for several years. 

Mr. Andrew Chan is a Partner in Litigation & Dispute Resolution at Allen & Gledhill LLP. His practice encompasses commercial work, and is a specialist in dispute resolution (especially arbitration), trusts, and insolvency (corporate and personal). In arbitration, he has acted as counsel, arbitrator and expert on Singapore law. He is a Fellow and the Honorary Secretary of the Singapore Institute of Arbitrators (as well as being on its panel of tutors) and a director of American Arbitration Association-ICDR Ltd. Andrew is on the panels of arbitrators of the Singapore International Arbitration Centre, the Law Society Arbitration Scheme and the Singapore Institute of Arbitrators. Andrew has written over sixty articles covering many areas of the law and has contributed to various publications. On arbitration, he has written extensively and is a co-author of the Singapore Chapter of the publication Arbitration in Asia. 

Mr. Ganesh Chandru is with Rajah & Tann LLP, Singapore where he specialises in International Arbitration and Commercial Litigation. He is admitted to practice in Singapore, England and India. Prior to joining Rajah & Tann, Ganesh was the Counsel & Assistant Registrar at the Singapore International Arbitration Centre (SIAC) for 5 years where he was involved in the administration of all international and domestic arbitrations that came under the care of SIAC. He supervised the administration of about 500 arbitrations during this period. He also pioneered SIAC’s initiatives in India and coordinated the setup of an arbitration centre in New Delhi spearheaded by the Construction Industry in India. 

He regularly speaks on arbitration and has lectured at the International Entry Course on Arbitration Law & Practice jointly conducted by the Singapore Institute of Arbitrators and the Chartered Institute of Arbitrators. He is a co-author of the Singapore Chapter in The International Comparative Legal Guide to International Arbitration (4th Edition, 2007). During his law school days, Ganesh was an avid participant in moot court competitions and he represented India at the Philip C. Jessup International Law Moot Court Competition in Washington DC, USA. He was among the top 5% of his LLB class. As a graduate student, Ganesh was awarded the NUS Research Scholarship and was conferred a Master of Laws degree by the National University of Singapore for his thesis on ‘International Commercial Arbitration and Information Technology’.

Ganesh is an Arbitrator on SIAC’s Panel of Arbitrators, a Fellow of the Chartered Institute of Arbitrators (CIArb), a Fellow of the Singapore Institute of Arbitrators (SIArb), a Panel Arbitrator on SIArb’s Panel of Arbitrators, a member of the Council of SIArb, a Committee Member of CIArb’s Singapore Branch, a member of LCIA’s Young International Arbitration Group, a member of the Autralasian Forum for International Arbitration, and a member of the Singapore Indian Chamber of Commerce & Industry. His practice encompasses advising and representing parties in Arbitration matters (both institutional and ad hoc) as well as in matters before the Courts. Ganesh acts as Arbitrator in International Arbitrations as well. He has been recognised in the ‘Global Arbitration Review 100 (2009)’ as a “significant” name.
